Terms and Conditions of Use

Before using this platform, please read the following terms and conditions carefully.

By accessing or using the platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree with any part of them, please do not use the platform. These Terms apply to regular subscription-based products. For recharge services, please refer to the Recharge Service Agreement.

1. General

1.1 This agreement and all attached or mentioned schedules and appendices (if any) ("Agreement") are an agreement between you and https://www.google.com/search?q=TopDealsPlus.com ("TopDealsPlus", "us" or "our").

1.2 This agreement shall govern, among other things: (a) The provision of TopDealsPlus services (see below for definition); (b) Your use of the platform (see below for definition).

1.3 The service is intended and can only be used by: (a) Individuals who are over 18 years of age and can enter into a legally binding contract under applicable law; (b) Individuals under the age of 18 and under the consent and direct supervision of their parents or legal guardians. Any individual under the age of 18 shall be deemed to have obtained the approval of his legal guardian or parent for all transactions conducted under this agreement, and the legal guardian or parent shall be responsible for any and all activities carried out by the individual under this agreement.

2. Definition and Interpretation

2.1 In these terms, unless the context requires otherwise, the following words have the following meanings:

• Account: Refers to the account created and used by you to access or use the platform.

• Buyer: Refers to the buyer of any goods and/or services.

• Goods and/or Services: Refer to digital items, goods, and/or services that are displayed, listed, and/or provided on the platform.

• TopDealsPlus Service: Pertains to the services and functions provided by TopDealsPlus on or through the platform from time to time.

• Information: Refers to any information, details, content, size, data, map, location, photos, text, description, specifications, audio or video clips, graphics and/or other materials.

• Intellectual Property: Refers to patents, registered designs, designs, copyrights, names, marks, trade names, trademarks, service marks and logos and all other knowledge, industry and/or ownership.

• Sales Contract: Refers to an agreement reached on the platform for the sale of any goods and/or services.

• Personal Data: Should have the meaning specified in the privacy policy.

• Privacy Policy: Refers to the policies governing the processing of personal data published by TopDealsPlus on the platform.

• Platform: Refers to the online platform (website, mobile site or mobile application) developed and/or operated by TopDealsPlus.

• Registration Process: Refers to the registration process established by TopDealsPlus for you to register and open an account with TopDealsPlus.

• Representative: Means employees, officials, agents, contractors, workers, personnel and/or representatives of related parties.

• You/Your: Refers to all users of the platform, primarily but not limited to buyers.

2.2 In this agreement, unless the context requires otherwise: (a) Indicates that the singular includes the plural, and vice versa; (b) The term indicating a natural person includes a corporate body and an unincorporated body; (c) Reference to any law, legislation or any provision of any law or legislation shall include all relevant provisions, statutory requirements and documents promulgated in accordance with that law, legislation or provision, as well as any changes, amendments or changes to any of the foregoing; (d) The title of this agreement is inserted for convenience only, and should not affect the interpretation or interpretation of this agreement.

3. Enter the Platform

3.1 If you wish to access the platform and TopDealsPlus services, you should create an account in TopDealsPlus according to the registration process. After successful registration, you can access the platform and TopDealsPlus services by logging into your account. TopDealsPlus has the right to conduct background checks on you, and has the right to decide on its own to refuse to grant you access to the platform and TopDealsPlus services or any part of it. During the registration process, you may be asked to provide additional verification or information.

3.2 You shall be solely responsible for the confidentiality and protection of the username and password of your account, and shall immediately notify TopDealsPlus of any unauthorized access to your account. Any instruction, notice or confirmation TopDealsPlus receives from your account shall be deemed to have been issued by you, although such notice or confirmation may have been issued by a third party, whether authorized or not, and you shall be bound by such instruction, notice or confirmation. TopDealsPlus is not responsible for actions taken in accordance with instructions, notices or confirmations sent through your account.

3.3 You should closely monitor all activities and transactions through your account. You should notify TopDealsPlus immediately regarding: (a) Any unusual activity or transaction related to your account; (b) When receiving any incomplete, garbled or inaccurate data or information from TopDealsPlus; (c) After receiving any data or information that is not suitable for you, you may not use or disclose any such data or information without TopDealsPlus's written consent.

3.4 Unless TopDealsPlus expressly agrees, each person is limited to one account. Do not create any accounts on behalf of or to impersonate others. If TopDealsPlus discovers that such a fraudulent account has been created, TopDealsPlus reserves the right to immediately suspend the account.

3.5 TopDealsPlus provides a variety of third-party account login functions. Users are aware that this function is provided and managed solely by the third-party service provider.

4. Use of Platform/TopDealsPlus Service

4.1 TopDealsPlus grants you a non-exclusive and non-transferable right to access and use the platform and TopDealsPlus services only within the scope necessary for this agreement. The platform and/or TopDealsPlus services must not be commercialized in any way.

4.2 The platform, TopDealsPlus service and/or all information contained on the platform shall be collectively referred to as the "TopDealsPlus platform/service". You may not: (a) Copy, distribute, recreate, and/or propagate the TopDealsPlus platform/service; (b) Rent, lease, sublicense, lend, translate, merge, adapt, change or modify the TopDealsPlus platform/service; (c) Disassemble, decompile, reverse engineer or create derivative works based on the TopDealsPlus platform/service; (d) Use TopDealsPlus platform/service in any illegal way, for any illegal purpose, or fraud; (e) Use any equipment, software or routines to interfere or attempt to interfere with the normal operation of the platform.

4.3 After registering with TopDealsPlus, you will automatically join the TopDealsPlus virtual family.

4.4 To ensure a quality experience for all users of the account, please ensure that your logged-in devices comply with the following guidelines: (a) No more than 1 device logged in at any time. (b) Only one device streaming at a time.

4.5 After the user pays, the service will continue to be effective during the validity period. If there is force majeure or third-party restrictions, TopDealsPlus can reasonably provide alternative solutions for performance. For matters related to refunds or compensation, please refer to the Refund Policy.

5. Personal Information

5.1 All personal data collected by TopDealsPlus will be processed by TopDealsPlus in accordance with the privacy policy published on the platform. For sensitive information involved in the recharge process, such as account credentials, passwords, and verification codes, please refer to the Recharge Service Agreement.

5.2 If any data or information provided by TopDealsPlus to you contains personal data, you agree to comply with the required privacy policy and data protection laws.

6. Confidentiality

6.1 "Confidential information" refers to all information of any type provided to the recipient by the disclosing party, including technical information, data, know-how, and trade secrets. 6.2 The recipient of any confidential information agrees not to disclose such confidential information to anyone unless required by law or with prior written approval. 6.5 All confidential information shall be used only for the purpose of this agreement.

7. Consumer Protection

7.1 Notwithstanding any provisions in this article, if applicable Consumer Protection Acts apply, this agreement is only intended to exclude or limit the remedies and rights you may have within the maximum scope permitted by the Act.

8. Warranty, Non-availability and Disclaimer

8.1 TopDealsPlus guarantees that TopDealsPlus services will be provided with reasonable care and skill. 8.2 TopDealsPlus does not guarantee that information provided by third parties is accurate, complete, reliable, or error-free. 8.3 Regarding the use of the platform, TopDealsPlus does not guarantee: (a) The functions will meet your requirements; (b) The operation will not be interrupted or error-free; (c) The platform is free of viruses or other harmful threats. 8.4 You accept that TopDealsPlus cannot guarantee the timely delivery of notices or confirmations due to telecommunications and data network delays.

9. Limitation of Liability

9.1 To the maximum extent permitted by laws and regulations: (a) The platform and services are provided on an "as is" basis; (b) TopDealsPlus shall not be liable for any costs, losses, or damages incurred by you due to any information provided through the platform; (c) Under no circumstances will TopDealsPlus pay any indirect, incidental, or punitive damages. (d) The claims, fines, penalties, liabilities and/or expenses incurred under this agreement shall not exceed [INSERT AMOUNT, e.g., USD 30] or the relevant fees paid by you for the disputed TopDealsPlus service, whichever is higher.

10. Compensation

10.1 You agree to defend, compensate and protect TopDealsPlus, its affiliates and their respective directors, officers, employees and agents from all expenses, losses, damages, claims, fines, penalties, liabilities and/or expenses due to your violation of this agreement.

11. Force Majeure

11.1 TopDealsPlus shall not be liable for any delay or failure to perform obligations due to reasons beyond reasonable control, including natural disasters, war, government actions, strikes, or telecommunications/system failures. (g) Due to policy adjustments, restrictions, suspensions or terminations by third-party service providers (including but not limited to third-party login interfaces, APIs, external authentication services or data support).

12. TopDealsPlus Rights and Suspension

12.1 TopDealsPlus has the right to immediately (without prior notice) suspend or stop your access, delete information, or restrict account activities if: (a) TopDealsPlus believes your performance of any sales contract does not conform to TopDealsPlus's unilateral judgment; (b) You violate any terms of this agreement.

13. Termination

13.1 TopDealsPlus may immediately terminate this agreement by written notice if you violate any terms and fail to correct such violations within 30 days. 13.2 Upon termination, you must stop all authorized activities and destroy/return confidential information. (d) In the event of termination due to the user’s breach, any fees already paid but not yet used shall be non-refundable.

14. Changes

14.1 TopDealsPlus reserves the right to add, delete, amend or modify this agreement at any time. Your continued use of the platform constitutes acceptance of these changes.

15. Notification

15.1 Notices shall be deemed delivered based on the method of transmission (e.g., email upon successful sending). 15.2 Notices to TopDealsPlus should be sent via email to support@topdealsplus.com.

16. Entire Agreement

16.1 This agreement constitutes the complete agreement between the parties and supersedes any prior oral or written agreements.

17. Assignment

17.1 Without TopDealsPlus's prior written consent, you may not assign any rights to a third party. TopDealsPlus may assign rights to its affiliates.

18. Payment Rules

18.1 One-Off Payment Rules (a) Purchase Page: You can select the duration of the subscription (e.g., 3, 6, or 12 months). (b) Service Validity: The subscription service will automatically cease when the specified period concludes. (c) Payment: You can use credit cards, debit cards, or other online payment methods. (f) Renewal Reminder: We will remind you three days before your subscription is about to expire by email.

18.2 Recurring Billing Rules (a) Billing Cycle: Billing will occur on the same day each month/cycle based on the initial subscription date. (b) Billing Notification: We will send a reminder email three days before each renewal with a link to unsubscribe. You can also cancel via your personal account. (c) Payment Method: You are required to link a valid payment method. Our website does not store sensitive information such as credit card security numbers (CVV). (e) Overdue Payment: If billing fails, we will attempt to bill again within the next 3 days. After 3 consecutive billing failures, the service will be suspended. (f) Cancellation: You can cancel at any time. To avoid the next billing, cancellation must be completed at least 24 hours before the next billing date.

19. No Waiver

19.1 Failure to exercise rights does not constitute a waiver of such rights.

20. Successors and Assigns

20.1 This agreement is binding on both parties and their permitted legal assignees.

21. Severability

21.1 If any provision is deemed illegal or unenforceable, the remaining provisions shall continue to apply.

22. No Partnership

22.1 Nothing in this agreement establishes a joint venture or partnership between the two parties.

23. Applicable Law

23.1 These TERMS AND CONDITIONS and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of [Insert Your Country/Jurisdiction, e.g., Pakistan].

24. Survival

24.1 Conditions of this agreement shall remain effective after termination or expiration.

Appendix A

(Pay) Buyer Pays: The relevant buyer shall pay the amount of any sales contract through the payment gateway available on the platform.

Limitation of Liability/Disclaimer: This website and affiliate network marketing plan are provided on an "as is" basis. We do not make any express or implied guarantees for this website. To the maximum extent permitted by applicable laws, we will not bear responsibilities for economic loss, loss of goodwill, or indirect/consequential loss.

Compensate and Remain Harmless: You agree to protect TopDealsPlus (and each of our officers, directors, members, employees, agents and affiliates) from any claims, demands, litigation, damages, losses, costs or expenses due to your use of our services or violation of these terms.
